A little over a third of Bristolwood participated in the
election by voting or coming to the meeting. The board
is looking at ways to increase participation and make it
easier for homeowners to vote. To achieve results we
need you to be part of the process.

EASTLAKE COMMUNITY WATCH

Hello Neighbors,

Two representatives of the CVPD addressed nearly 150 Greens/Trails residents regarding a recent rash of home burglaries and auto thefts in our Eastlake neighborhoods. There were 18 reported incidents in Eastlake II/III through the month of October.

Officer Leo Banales provided general precautions to avoid being a victim of these crimes. He indicated the suspects have been focusing their efforts on easy targets, i.e., open garage doors, unlocked front/back/side doors, open windows etc. These crimes have generally occurred during daylight hours when the homes were unoccupied. Bottom line, lock your doors even if your only running to a local store for a few minutes.

A few tips offered:

Ensure you front door peep-hole does not have an obstructed view (seasonal wreath etc.)
Make good use of exterior lighting to include motion sensors.
All exterior doors should have a deadbolt with a one-inch throw.
Know who is at your door prior to opening.
Ensure your sliding door has a lift prevention kit installed on the top rail.
Place a security bar (sturdy wood or metal) in the bottom track of your sliding glass door.
Always close and lock your garage door.
Lock the door leading from your garage to home's interior.
Lock your vehicles and do not let your garage door opener in view (it is better to take it inside your home).


Officer Banales reminded residents to be alert to any/all suspicious activity or suspicous (out-of-place) persons in our neighborhood and not to hesistate to call dispatch at (619) 691-5151 to report suspicious activity. Do your best to have a description of the individual or car when calling. If you have unoccupied/vacant homes in your immediate neighborhood, keep an eye them as these have also been a draw for criminal activity.

Finally the issue of loud parties / loud noise was addressed. Noise complaints can be called in to dispatch (619) 691-5151 at any time, yes, even during the middle of the day. Officer Banales recounted when he was a patrol officer and would have to work the grave-yard shift and sleep during the day. Resources permitting CVPD will respond and inform the offender to reduce the volume.

Our Plan for the Future

An association’s health is primarily measured by its financial status. Property values are negatively impacted by low reserve funds, failure to recoup delinquent assessments and unethical spending practices. The Board of Directors are hard at work to improve our equity through sound financial planning, fiscal responsibility, and maintaining focus on strengthening our assets. As a result, Bristolwood’s reserves are at over $68,000- more than double what they were just four years ago. As of August 2009 our total assets are over $83,000. After our latest budget review and acceptance we anticipate our reserves to be 100% funded as early as 3 years from now.
Review our plan for the coming years below.
The volunteer board and management team have a fiduciary responsibility to protect and maintain the HOA’s assets. This is our guide: Property Values are negatively affected by:
 LOW Reserve Funding levels (Bristolwood reserves steadily growing)
 Delinquencies (aggressive policy in place, small claims judgments, liens)
 High ratio of rental properties (monitor impact on HOA if any, i.e., CC&R compliance, assessment delinquency and open communication with homeowner, approximately ¼ of Bristolwood is rental property, plan for future potentials)
Reserve Funding
 Spreads replacement cost over the assets’ useful life. (Use reserve study to forecast projects)
 Try to maintain at least 80-100% of the “ideal” reserve funding. (Bristolwood at 60%)
 Reserve funding is disclosed (by law) to potential buyers and lenders. Under-funded
 reserves are a red flag.
 Review the reserve analyst’s assumptions.

 Long-term vision for the community (Vision adopted)
 What will things look like in 10, 20 years? (still in planning stages)

Dear Homeowners,

The Annual Meeting for the BRISTOLWOOD Homeowners Association is scheduled to take place on:

The purpose of this meeting is to elect two (2) members to serve on the Board of Directors of the BRISTOLWOOD Homeowners Association for a term of two years.

It is very important that you attend this meeting, either in person or by proxy (the proxy also constitutes attendance at the meeting), since a quorum of 51% of the members is required to hold this meeting. Please fill out and return the enclosed proxy no later than 5:00 p.m. on Friday, October 2, 2009. If you send in a proxy and find you can attend, your proxy will be returned to you at the meeting.

If you cannot attend the meeting, you may give authorization to another member, person or the Board to vote on your behalf, by completing the enclosed “proxy” and giving your proxy and “Instructions to Proxy Holders” to that person. Your proxy holder must be present at the annual meeting to cast your votes.

Nominations may be made from the floor. The candidates receiving the highest number of votes shall be deemed elected. If you return your ballot by mail, your ballot cannot be returned to you at any time. If you return your ballot by mail and there is a nomination made from the floor, you will not be able to vote for that nominee. If a unit is owned by more than one person, only one ballot or proxy may be cast for that unit. “Cumulative Voting” will apply, which means that you may cast all of your votes for one person or divide the votes among the candidates. More than two votes will void the ballot.

Welcome new Board Members

We would like to welcome two new Board Members to our HOA. That makes 5 board members now. The more the merrier. Thank you Penny & Elizabeth for your commitment to our HOA. We hope for your continued dedication in upholding the CC&Rs of our HOA and your active participation in the on-going projects.
The following changes have been made during our board meeting yesterday, Aug. 3rd.
Lorie has been promoted to Vice President. Penny has assumed Lorie's role as Treasurer. Paul still remains as the Board Secretary.

CONGRATULATIONS TEAM ! The streets look great after the recent slurry seal and repainting of the pavements. This should last for another 5 years. The addition of the speed bumps and 15 mph signs has certainly been effective in preventing speeders from driving recklessly in and out of our community.

OTAY WATER DISTRICT AT LEVEL 1 – DROUGHT WATCH

The Otay Water District is at a Level 1 – Drought Watch and water conservation remains voluntary for customers in the district’s East County and South Bay service area. Otay Water District customers are not under the same water use restrictions as residents of the City of San Diego. Otay customers are achieving conservation goals through voluntary measures.

Because of the high level of water conservation that Otay Water District customers are achieving and a greater reliance on recycled water used for landscape irrigation, the Otay Water District has not instituted a Level 2 - Drought Alert, watering restrictions, or mandatory water conservation.

Past investments in recycled water infrastructure are contributing to the district achieving its conservation goals. Recycled water is a drought-proof supply of water used for landscape irrigation and the Otay Water District has one of the largest recycled water networks in San Diego County. Every gallon of recycled water used for landscape irrigation conserves a gallon of drinking water.

The district nevertheless continues to urge its customers to save water by:

• Repairing all water leaks promptly.
• Use a broom to clean paved surfaces such as sidewalks, driveways, or patios.
• When irrigating, stop water waste from runoff, overspray, broken or misdirected sprinkler heads.
• Irrigate before 10:00 a.m. and after 6:00 p.m. and no more than three days per week, 15 minutes per valve.
• Wash vehicles using a bucket and a hose with a positive shot-off nozzle, or use a commercial car wash that recycles water onsite.

Speeding in Bristolwood

Bristolwood has had an increase in speeding reports from our members. We are proud to be a pedestrian friendly neighborhood and we’re committed to reducing the incidents of speeding on our street. This includes working with Chula Vista Police Department and fostering an education plan about speeding for our members.

Did you know that the entire length of La Costa Ave measures less than four tenths (.4) of a mile? If you travel from one end of La Costa Ave to the other at the posted 15 MPH limit, it will take exactly 1 minute and 36 seconds. Increasing the speed to 25 MPH reduces the total travel time by only 30 seconds but will double the required stopping distance of your vehicle.
Here’s a quick chart that shows the total time versus stopping distance at various speeds:

Tips for Lawn Care

Water your lawn in the Morning
You can water your lawn at any time of the day if it is severely stressed, however, if you are merely maintaining your lawn, you should avoid late evening or middle day watering. Late evening watering can encourage the growth of fungus, while heat of the day watering can waste water. The best time of day for lawn watering is in the early morning, before the sun can scorch your landscape, giving it plenty of time to dry out before evening. Additionally, set the length of your watering cycle to minimize water run-off into the street. Water run-off from your yard carries pollutants and yard debris in our sewer system and wastes large amounts of water. The San Diego County Water Authority has a web site with very useful information including a drought level watch (we’re currently in Level 2) and tips for water conservation. They also offer many rebate programs for installing high efficiency washers and toilets, replacing sprinkler heads with rotating nozzle heads, and installing synthetic turf. Recently, the City of Escondido implemented mandatory water rationing. They can only water on certain days of the week and “water cops” are deployed to investigate reports of water wasting which result in fines and water cut off.
Fertilize Routinely
Many organic fertilizers are now available in pre-blended formulas like granular or powdered form. Be wary of a fertilizer labeled organic that has an N-P-K ratio adding up to more than 15. This is an indicator that it may not indeed be made of organic materials -- so read labels carefully. Know what you put on your play areas!
How do I read a fertilizer label?
The label on fertilizer bags lists the percentages of the three primary nutrients (nitrogen, phosphorous and potassium) as a series of three numbers called the fertilizer grade. For example, if the label has 23-3-6 on the label, the fertilizer contains 23 percent nitrogen, 3 percent phosphorous and 6 percent potassium.
What if I apply too much fertilizer?
Too much nitrogen can burn your grass. That's why it is best to apply moderate amounts of fertilizer on a regular basis rather than large amounts infrequently. For quickly available forms of nitrogen, no more than one pound of nitrogen per 1000 square feet should be applied in a single application. Once you've applied the fertilizer, there's no turning back. All you can do is stop fertilizing immediately. Rain and watering will carry away the excess over time.

Recycle Grass – Use a Mulch mower
One question many home lawn care enthusiast ask is if mulching grass clipping is beneficial or harmful.
The University of Florida reports that by allowing the grass clipping to drop onto the lawn instead of bagging the grass the yard does get some benefits.
In fact, the UF claims that about 3% nitrogen is contained in the dry weight of grass clippings. Put another way. One hundred pounds of dry grass clippings hold an equal amount of Nitrogen as a 50-pound bag of 6-6-6.
Allowing the cut grass to return to the soil puts valuable nutrients back into the soil. Not only Nitrogen but also other essential elements like Phosphorus, Potassium, Manganese and Iron. Grass clippings quickly decompose. Some "mowers" bag their clipping since they believe the clippings contribute to the build up of thatch.
Fact is, grass clippings contain sugars which stimulate microbes that help with the decomposing of thatch. So keeping grass clippings on the lawn can actually offer benefits.
Another benefit is environmental. There are estimates that we could save 10% of the space in our landfills if we did not bag the grass clippings when mowing our lawn. Plus there is also the time saving factor. Less time mowing – less time bagging.

Parking Rules

In accordance with Bristolwood at Eastlake Greens CC&R’s 6.7 Enforcement, 4.3.2 Enforcement Actions and 3.4.7(d) Parking Control

General:
•The speed limit on La Costa Ave is 15 MPH and will be strictly enforced by using any or all of the
methods: reporting the license number of the speeding vehicle to the CVPD, courtesy letter to
homeowner, and/or fine imposition by the board of directors.
•No Vehicle parked on La Costa Ave or on the driveway of an individual homeowner may block or
encroach on any Bristolwood sidewalk or interfere with access to the driveway of another residence.
•All Bristolwood residents will comply with Eastlake CC&R 9.3.3 – “No trailer, camper boat or
recreational vehicle, commercial vehicle or similar equipment shall be permitted to remain upon the
property, unless placed or maintained within an enclosed garage, not permitted to be parked other than
for temporary purposes of loading, unloading or cleaning…”
•In accordance with Eastlake Greens CC&R 9.3.3 residents are not permitted to dismantle, rebuild,
repair, service or paint motorized vehicles on the Property unless performed within an enclosed
garage.
•All residents will comply with applicable California state laws and DMV requirements, including
legal registration.
•Owners of vehicles parked on the street will be responsible for oil leaks onto the pavement. The cost
of repairs for damaged pavement will be the sole responsibility of the owner in accordance with
Bristolwood at Eastlake Greens CC&R 6.7
•Visitors of Bristolwood residents are required to post signage in the front windshield identifying
where the car owner can be contacted, which house number is being visited and the date.

Residents:
•Each resident is responsible for posting the required parking permit in the front windshield of their
vehicle when parking in their designated parking space on the street.
•Each resident has one on street parking space which is designated by their house number located on
the curb in front of their home.
•Residents may not park in a designated parking space of another resident without consent of the
parking space designee. In the event of an emergency situation a legible note will be posted in the
windshield identifying the address being visited and contact telephone number. The maximum time
allowed will be 4 hours.
•Residents have authority to cause the action of towing a vehicle that is parked in their designated
parking space.

Island Parking:
•All vehicles parked in the islands are required to have to a valid parking permit.
•Island Parking is the priority parking for residents without curb parking and also serves as designated
visitor parking.
•Owners of vehicles parked in the islands will be responsible for oil leaks onto the pavement. The cost
of repairs for damaged pavement will be the sole responsibility of the owner in accordance with
CC&R 6.7

Parking Enforcement:
•The parking enforcement committee conducts monthly and random inspections of Bristolwood to
ensure compliance with regulations.
•Residents may report parking violations or speeding to the property manager – in writing – for
investigation by the parking enforcement committee and the Board of Directors.
•The Parking Enforcement Committee will issue warning tickets to residents when residents are not in compliance with parking regulations set forth in this document. Immediate compliance is required
when a resident receives a parking warning ticket. Non-compliance will result in fines and/or towing
of the vehicle not in compliance (pursuant to applicable Civil Code and CC&R’s)
•The association (pursuant to applicable Civil Code and CC&R’s) can cause the removal, by towing, of any vehicle that is in violation of these parking rules and regulations

FINE POLICY

BRISTOLWOOD COMMUNITY ASSOCIATION

CCR VIOLATION ENFORCEMENT PROCEDURES & FINES

FINE SCHEDULE AND FOLLOWUP PROCEDURE



1. After the initial fine is levied on the Homeowner in violation, a letter will be sent stating that of the violation is not corrected in fifteen (15) days, the following action will be taken:

A. Additional fines will be levied daily for each day that the violation continues.

B. Fines for Violations may be levied in accordance with the following schedule.
Use Restrictions Up to $50.00
Vehicle and Parking Restrictions Up to $50.00
Other Violations of the CCRs or Bylaws Up to $50.00
Rules or Regulations

C. Fines shall be in addition to a monetary charge equal to any applicable cost of
Repair or to reimburse the Association for cost incurred to bring the Owner into compliance for which the Owner is responsible.


D. The next action to be taken at the discretion of the Board of Directors or upon Recommendation from the Eastlake Architectural Review Committee , will be to serve a request for alternate dispute resolution on the Homeowner as required by Civil Code Section 1354, prior to filing a lawsuit for injunctive relief. Attorney’s fees and costs for the preparation of, filing and service of a complaint will be charged to the account of the Homeowners account. The Association is entitled to claim for reimbursement of attorney’s fees and costs under the Declaration, and the court will be asked to award these fees and costs to the prevailing party.

Policy Regarding our GARAGE USAGE

Garages

· Garage doors left open for extended periods of time promote breaking and entering in the neighborhood
· Garage doors left open for extended periods of time allow unwanted animals, including rodents, to enter and they might “move in”

(Article IX, Section 9.3.9)

1. No garage door shall be permitted to remain open except for ingress and egress.

2. No pad or space adjacent to the garage or any other portion of a lot other than a driveway shall be used for the parking of any vehicles whatsoever.

3. Garages shall be used for vehicles and other personal storage only.

4. No hazardous materials shall be stored in any garage.

5. Garages may not be converted into any kind of living area or be used as a living area.
